These Terms govern membership, use of the facility, and the risks connected to physical exercise at Savage Elite Fitness.
1.Definitions
Savage: Savage Elite Fitness.
Member: the natural person in whose name the membership is registered.
Membership: the agreed right to use specified Savage facilities, classes, programs, or services.
Membership Confirmation: the personal confirmation stating the selected plan, price, currency, billing frequency, start date, minimum term, renewal, cancellation notice, and any plan-specific terms.
Facility: the location, training spaces, and other areas managed by Savage.
House Rules: Savage’s current conduct, safety, hygiene, and privacy rules.
2.Application and order of documents
The agreement consists of:
1. the Membership Confirmation; 2. these Membership Terms & Risk Waiver; 3. the House Rules; 4. any clearly stated plan, promotion, or program terms.
Specific information in the Membership Confirmation takes priority where it describes the selected plan, price, duration, or included services.
Mandatory law always takes priority.
3.Formation
A membership is formed after:
- the member provides the required information;
- Savage accepts the registration;
- the applicable terms and risk waiver are accepted;
- any required payment or payment authorization is received; and
- Savage issues written or electronic confirmation.
Electronic acceptance through an unchecked consent box and confirmation button constitutes agreement.
4.Required plan information
Before confirmation, the member must receive clear information about:
- membership name and contents;
- price and currency;
- billing frequency;
- sign-up fee;
- prorated amount, if applicable;
- start date;
- first payment date;
- fixed minimum term or absence of one;
- automatic renewal;
- cancellation notice;
- included services;
- plan-specific limitations.
An essential field must not be blank. Where something does not apply, it must state “Not applicable”.
5.Age and minors
A person must be at least 18 to enter into a membership independently.
A minor may participate only where:
- a parent or legal guardian gives permission;
- that person also accepts the agreement;
- Savage’s age and supervision rules are followed; and
- the relevant program is suitable for the minor’s age.
Savage may apply additional age limits to certain areas, equipment, classes, or times.
6.Personal and non-transferable
A membership is personal.
You must not:
- share an access card, QR code, or account;
- allow another person to enter under your identity;
- transfer the membership without written permission;
- use a discount or arrangement for which you are not eligible.
Savage may request identification. Misuse may lead to blocking, suspension, or termination.
7.Health declaration
By participating, the member confirms that:
- to the best of the member’s knowledge, the member is physically able to exercise;
- relevant injuries, limitations, pregnancy, medication, or health risks will be disclosed where they may affect safe participation;
- medical or other qualified advice will be obtained in advance where there is doubt;
- the member will not exercise where a doctor has advised against participation;
- intensity will be adjusted to the member’s experience and capacity;
- the member will stop immediately in the event of chest pain, severe shortness of breath, dizziness, loss of consciousness, acute pain, or other concerning symptoms.
Savage does not conduct a medical examination and cannot independently determine medical fitness to exercise.
8.Acknowledgment and acceptance of risk
The member understands that fitness, strength training, cardio, group classes, personal training, and other physical activities involve risk.
Possible risks include:
- strains, sprains, and overuse injuries;
- joint, back, tendon, and muscular complaints;
- falling, slipping, or collision;
- contact with equipment, weights, or other people;
- fractures;
- dehydration or overheating;
- aggravation of a known or unknown condition;
- cardiac or other serious health complications;
- in exceptional cases, permanent injury or death.
Not every risk can be eliminated, even with proper maintenance, supervision, and compliance with rules.
The member participates voluntarily and accepts the normal inherent risks of the selected activity.
9.Safe use and instructions
The member must:
- follow reasonable directions from trainers and staff;
- use equipment only for its intended purpose;
- not remove or bypass safety devices;
- ask for assistance where operation or technique is unclear;
- adjust intensity to experience and condition;
- immediately report defects, damage, or dangerous conditions;
- not use equipment marked defective or out of service;
- follow the House Rules.
A trainer or staff member may stop an exercise, session, or participation where continuation is reasonably considered unsafe.
10.Emergencies
In a suspected emergency, Savage may:
- provide first aid;
- contact emergency services;
- contact the stated emergency contact;
- share reasonably necessary information with responders.
The cost of external medical treatment or transport is the member’s responsibility, except to the extent it directly results from a breach for which Savage is liable.
11.No guarantee of results
Results differ and depend on effort, frequency, nutrition, recovery, health, genetics, and adherence to a program.
Savage and its trainers do not guarantee specific weight loss, muscle gain, performance, recovery, or other outcomes.
12.Prices and payments
The member must pay the amounts stated in the Membership Confirmation.
The price, currency, billing frequency, sign-up fee, prorated amount, and other mandatory costs must be shown before confirmation.
If an amount is denominated in US dollars but paid in Surinamese dollars, the applicable exchange rate or calculation method must be shown before payment.
Where the member chooses a recurring payment method, the member authorizes collection of the agreed periodic amounts. This authorization applies only to amounts due under the agreement.
13.Failed or overdue payment
If a payment fails or becomes overdue:
- Savage will notify the member;
- the member has 7 calendar days after notice to cure the default;
- Savage may then suspend access while an amount remains due;
- the payment obligation continues;
- only previously disclosed and legally permitted charges may be applied.
Suspension for overdue payment does not automatically terminate the agreement.
14.Price changes
Savage may change prices for future contract periods or monthly continuation after a fixed minimum term.
A material price change will be communicated at least 30 calendar days in advance.
The price will not be unilaterally increased during an agreed fixed minimum term, except for a legal levy, a plan change chosen by the member, or an objectively defined adjustment clearly disclosed in advance.
Where an increase applies after the minimum term, the member may cancel before the effective date using the applicable procedure.
15.Term and renewal
The term is stated in the Membership Confirmation.
A membership may:
- have a fixed minimum term;
- have no fixed minimum term;
- apply to a specific period, program, or number of sessions.
Unless the specific plan clearly states otherwise, a membership continues month-to-month after the fixed minimum term.
Automatic renewal must be clearly shown before the agreement is concluded.
16.Cancellation by the member
Formal cancellation may be submitted:
- through the member portal;
- by email to info@savageden.sr;
- through the official WhatsApp number +597 766-7447.
A message to a trainer, an employee’s private number, or a social-media account is not formal cancellation.
After the minimum term, at least 30 calendar days’ notice applies. Cancellation takes effect at the end of the applicable billing period after the full notice period has passed, unless the Membership Confirmation provides more favorable terms.
Cancellation is complete only when Savage has confirmed in writing:
- the date the request was received;
- the final contract and access date;
- whether any balance remains due.
During a fixed minimum term, the member remains liable until the end of that term unless early termination is approved.
17.Early medical termination or relocation
Savage may allow termination before the end of a minimum term where:
- a qualified medical professional confirms that the member cannot reasonably exercise for at least 3 consecutive months; or
- the member permanently relocates outside a reasonable commuting distance from the facility; or
- another exceptional circumstance makes continuation unreasonable.
Savage may request reasonable evidence. A medical statement does not need to disclose a detailed diagnosis.
Termination takes effect after the complete request and evidence are received and approved. Past periods are not refunded. Prepaid amounts for periods after the approved end date will be refunded proportionally, less any lawfully due amounts.
18.Freeze
A freeze is available only after written approval.
The standard policy is:
- full calendar months;
- minimum 1 month;
- maximum 3 months in any rolling 12-month period;
- request before the next billing date;
- the minimum term is extended by the same period;
- no access during the freeze unless otherwise agreed in writing;
- no retroactive freeze except for a documented emergency.
Possible grounds include a medical limitation, pregnancy, extended travel, or another documented circumstance.
19.No refund for non-use
Failure to use or limited use of the facility does not by itself create a right to refund, discount, or extension.
This includes vacation, workload, a change in personal schedule, loss of motivation, or temporary absence without an approved freeze.
This does not limit rights arising from an extended closure, approved medical termination, or a breach for which Savage is responsible.
20.Classes, bookings, and no-shows
Some classes or sessions may require a reservation.
The member must cancel within the period shown at booking.
For repeated no-shows or late cancellations, Savage may:
- temporarily limit booking privileges;
- apply a fee clearly disclosed in advance;
- count a package session as used where disclosed in advance.
If Savage cancels a paid single session, a reasonable alternative, credit, or refund will be offered.
21.Opening hours, trainers, and facilities
Savage may reasonably change opening hours, class schedules, trainers, areas, equipment, and program content because of maintenance, safety, holidays, staffing, events, or operational circumstances.
A particular trainer, class, machine, or area is not permanently guaranteed unless agreed in writing.
If there is an extended and material reduction in the agreed service, Savage will seek a reasonable solution.
22.Personal training and commercial activity
Personal training and coaching may be subject to additional package terms.
Only Savage-authorized persons may provide commercial training, coaching, sales, promotion, or solicitation at the facility.
Payments for Savage services must be made through approved channels.
23.Liability and indemnity
Savage is not liable for injury, damage, or loss arising solely from:
- normal inherent risks of physical training;
- a known or undisclosed health condition;
- exceeding personal capacity;
- misuse of equipment;
- ignoring instructions, warnings, or House Rules;
- participation under the influence of alcohol, drugs, or other substances affecting safe exercise;
- intentional, reckless, or unsafe conduct by the member;
- conduct of another visitor that Savage could not reasonably control.
Savage remains responsible to the extent loss is directly caused by a breach attributable to Savage that cannot validly be excluded, including intentional misconduct, conscious recklessness, or a serious safety defect that Savage knew or reasonably should have corrected.
The member indemnifies Savage against reasonable third-party claims arising directly from the member’s intentional, reckless, or unlawful conduct.
Nothing in these Terms limits rights or liability where limitation is not permitted by mandatory law.
24.Property, lockers, and parking
Personal property is brought at the member’s own responsibility.
Lockers are for temporary use during a visit and not permanent storage unless expressly allowed.
Savage is not liable for loss, theft, or damage except to the extent directly caused by a breach attributable to Savage that cannot validly be excluded.
Parking and bicycle storage are used at the user’s own risk and subject to posted directions.
25.Damage caused by a member
The member is responsible for damage caused intentionally, recklessly, or through clearly improper use to the facility, equipment, or property of Savage, staff, or other visitors.
Normal wear and tear is excluded.
Savage may recover reasonable repair or replacement costs after investigating and informing the member.
26.House Rules, suspension, and termination by Savage
The House Rules form part of the agreement.
Savage may suspend access or terminate the membership for matters including:
- overdue payment;
- fraud or access misuse;
- violence, threats, or harassment;
- discrimination or sexual harassment;
- theft or vandalism;
- possession, sale, or use of prohibited substances;
- exercising under the influence;
- dangerous use of equipment;
- unauthorized commercial activity;
- serious or repeated breach of House Rules;
- conduct harming the safety, privacy, or wellbeing of others.
Savage may first warn where a breach can be corrected. It may act immediately in serious cases.
If Savage terminates for business reasons without breach by the member, prepaid amounts for future undelivered periods will be refunded proportionally.
27.Photography, video, and privacy
Entering a membership does not automatically give permission for individually identifiable promotional photos or videos.
Promotional permission is requested separately and is optional.
A member may not record another person in an identifiable way without permission. Recording is always prohibited in changing rooms, showers, and toilets.
Personal data is processed under the Privacy Statement.
28.Complaints and incidents
Report complaints and incidents as soon as possible through:
Email: info@savageden.sr WhatsApp: +597 766-7447 Address: Ringweg-Zuid 245, Munder, Paramaribo, Suriname
Where possible, include name, contact details, date, time, description, people involved, and relevant documents or images.
Savage aims to acknowledge a complaint within 2 business days and provide a substantive response within 10 business days.
29.Force majeure
Savage is not liable for temporary non-performance caused by circumstances outside its reasonable control, such as natural disaster, fire, flood, epidemic, government action, civil unrest, major outages, or unforeseen safety risks.
Savage will try to reduce the impact and communicate reasonable alternatives where possible.
For an extended closure, Savage will consider whether an extension, credit, freeze, or partial refund is reasonable.
30.Changes
Savage may update these Terms where necessary because of regulation, safety, services, technology, or operations.
A change will not alter an already agreed fixed price or minimum term without consent, unless legally required.
Material changes will be communicated in advance.
31.Governing law, language, and disputes
The membership agreement is governed by the laws of the Republic of Suriname.
If the Dutch and English versions are interpreted differently, the Dutch version prevails to the extent permitted by mandatory law.
The parties will first try to resolve a dispute in good faith. If no solution is reached, the matter may be submitted to the competent court in Suriname unless mandatory law provides otherwise.
